A lawsuit has been filed alleging that Ohio regulators bypassed updated environmental and safety rules when permitting fracking waste injection wells in Southeast Ohio, intensifying an ongoing controversy in the region. The Ohio Department of Natural Resources (ODNR) approved permits in 2025 for two deep underground injection wells operated by Deeprock Disposal Solutions near Marietta, Washington County, using outdated regulations that were replaced in 2022 with stronger protections. The environmental group Buckeye Environmental Network initiated the lawsuit, contending that ODNR’s reliance on the older, less stringent 2021 rules failed to adequately safeguard groundwater, public health, and nearby communities.

These wells, located within two miles of critical drinking water aquifers and Marietta’s source water protection area, are intended to store millions of gallons of liquid fracking waste—a toxic mix containing carcinogenic heavy metals and radioactive materials—from natural gas production. The plaintiffs warn that the cumulative risk of waste injection, combined with a history of leaks, blowouts, and contamination incidents in the region, poses serious threats to water quality. Past incidents include leakage events where brine surfaced miles from injection sites, forcing expensive cleanups and regulatory shutdowns.

The lawsuit urges the 10th District Court of Appeals to rescind the permits and compel ODNR to reevaluate under the current, more protective regulations that would require stricter construction standards and thorough reviews of surrounding water sources. Local officials, including Marietta City Council President Susan Vessels, emphasize the potential environmental dangers, citing concerns that the volume of waste injected could rival the scale of historic environmental disasters. This legal challenge is part of a broader conflict between Washington County communities and state regulators over the management of oil and gas waste and the safeguarding of vital water resources in Southeast Ohio.

ODNR declined to comment on the pending litigation, which could set a statewide precedent for the regulation and permitting of injection wells in Ohio, shaping future policy for the natural gas industry’s waste disposal practices.

This suit marks an escalation in the ongoing debate over fracking waste disposal, balancing economic interests in Ohio’s energy sector with the environmental and public health risks perceived by local communities and advocates.
