More than a year and a half after the incident, the residents have filed a “Relief from Judgement” motion with an Ohio District Court, claiming they were “misled” during the settlement process. The heart of the complaint is the allegation that they were denied full access to critical information concerning the long-term health risks associated with the toxic chemical spill.
The motion asserts that medical expert reports, which warned of potential multi-generational health impacts, were allegedly concealed by both defense and class counsel. Consequently, the residents argue that the agreed-upon financial settlement is insufficient to cover the potential for years of future medical expenses.
The legal action, filed last week, seeks judicial approval to allow those who already opted into the settlement to withdraw from the agreement. If successful, this move could unravel a major part of the compensation plan for victims and reignite litigation against Norfolk Southern. The court must now weigh the claims of deception against the finality of the settlement.
